Constitution of Gurkland

Preamble:
In the name of Goddess Madoka's Celestial Love!

The people who populate Gurkland, to create a perfect and enlightened nation, ensuring sustained economic growth, peace abroad and at home, and tighten the possession of the benedictions of autonomy, brotherhood and sisterhood, sensitive of us responsibility towards Madoka's Creation,

resolved to renew their alliance so as to strengthen liberty, democracy, independence and peace in a spirit of solidarity and openness towards the Wonderlands, Wastelands and all of the Multiverse,

determined to live together with mutual consideration and respect for diversity,

conscious of their common technology achievements

and in the knowledge that only those who use their freedom remain free, and that the strength of a people is measured by the well-being of its weakest members;

adopt the following Constitution:

GENERAL:
Article 1: Gurkland is a Unitary, Semi-direct democratic knowledge-based free market economy with gesellian monetary system and with the intervention of the state to remedy the most negative externalities.

EXECUTIVE BRANCH:
Article 2: The Monarch shall be the symbol of the State and of the unity of the People, deriving his position from the will of the people with whom resides sovereign power.
Article 3: Economic, military and national security advisers and press agents are required to guide the executive branch, and the Board of Directors shall be responsible thereof.
Article 4: The Monarch is the arbitrary surveyor of the correct continuation of political affairs of the country. To He is required the protection of the free and permissive rights of this age-old constitution. He has the power of ceremonial meetings with other leaders to represent Gurkland at international conferences.
Article 5: The Monarch, as such, is the commander in chief of all the military forces in the country. He may send at its own discretion armies abroad, it is informed on trends in strategic defensive wars. It is allowed him the right insured to declare war with the approval of the Legislative Council. This Constitution makes it legal for the Monarch and the Parlament to declare war and His Majesty can direct the troops in the case of both an external and an offensive attack.
Article 6: The office of the Monarch of the nation is esclusive to the sole founder of the nation(Chosed 100,000 years ago). In his/her absence or his/her abdication the Monarch will be elected every 80 years by popular vote. The mandates are limited to only 1 term.
Article 7: The head of the political party that enjoys the absolute majority in the Legislative Council will be appointed Prime Minister by the Monarch to control the ruling coalition. If there is no absolute majority in parliament, popular election of the Prime Minister will be held to decide who will be the figure to fill this important role.
Article 8: The Prime Minister, as head of Government in the Legislative Council must holds most of the executive power outside of the military sphere, which is under the jurisdiction of the Monarch.
He will coordinate and supervise the public administrations, chooses the ministers, may move or dismiss ministers, it is primarily responsible for the nation's foreign policy and as the political head of the Civil Sector he is responsible for the appointment of Public Managers.

LEGISLATIVE BRANCH:
Article 9: The legislature will reside in the local seats of the House of Commons, in which every citizen over the age of 15 with the intellectual equivalent of a university education will be able to enroll and participate in decisions and popular initiatives if him/her builds a test on knowledge of the State of Gurkland, getting a voting license that will allow him/her to enter fully into the House of Commons rooms. These locations will be headed by the Grand seat of the House of Commons in Sheoth.
Article 10: The House of Commons of ordinary citizens will have powers comparable to the Lower House. Collections of taxes and government spending will be managed in a model of proportional fiscal federalist participatory budgeting in all cities.
Article 11: The Legislative Council shall be composed of 3020 parlamentarians chosen every 2 years by the people of the many domains of the country.
Article 12: Anyone who is a permanent resident of Gurkland has the political right to join with other compatriots in order to record and organize a political party to challenge the other parties in the management of the affairs of the country peacefully and with a platform to discuss openly.
Article 13: The less critical political decisions of Gurkland are the expression of the will of the people by referendum, petitions and the approval of the Prime Minister. Gurkland keeps a list of classification of policy initiatives that have 5 levels decided by the Supreme Court of Gurkland. 1 is the most critical and 5 the blander. Citizens can not vote policy initiatives that outweigh the third level of criticality. The Prime Minister and the parliament can not reject or ignore petitions that have the consent of more than 4% of the population of Gurkland, or reject them four times in succession. Critical decisions to national security are decided by the Monarch and the Legislative Council in their fields that have in themselves the executive and legislative power on it.
Article 14: The planets that are part of the Monarchy of Gurkland are united and are subject to the same laws from the centralized government.
Article 15: Unconstitutional People's Iniatives and considered dangerous by the Court of Gurkland are not taken into account in the political process.
Article 16: The legacy of any royal position (Monarch, Duke, Count etc) is not permitted and the nobles are always chosen by consensus and by criteria of merit.

CORRECT ESTABLISHMENT:
Article 17: Parlamentarians have no special economic privileges than ordinary citizens.
Article 18: Parlamentarians have not annuities.
Article 19: Parlamentarians can have a double job as long as it does not go in conflict of interest with the parliamentary activity.
Article 20: The salary of a Gurklandese elected parliamentarian may not exceed 150% of the average income of a citizen of Gurkland.

FREEDOM AND RIGHTS:
Article 22: Religious freedom is guaranteed and churches are considered non-profit organizations.
Article 23: The media freedom is guaranteed and the State declassify state secrets older than 30 years. Quacks and alarmist news that prove to be false by rigorous scientific studies are not tolerated in Gurkland. The state must not threaten an Media for different political, philosophical, religious opinions and everything else.
Article 24: The freedom of the individual is guaranteed and nonconformity encouraged.
Article 25: An individual has the sacrosanct freedom to travel wherever he pleases without any constraints, except for reasons of extreme safety (i.e. The individual in question is a terrorist).
Article 26: Freedom of association and non-violent protest is guaranteed. Who damage and threatens the security of the neighborhood destroying public and private property will be prosecuted for the crime he will commit.
Article 27: The right to strike is one of the foundations of democracy and is guaranteed.
Article 28: Political participation is a human right. Voting is secret and voluntary.
Article 29: The law is equal for all, regardless of sexual orientation, ethnicity, religion, physical appearance, political opinions and material well-being. Each defendant must use Free Public defenders.
Article 30: Everyone can travel and enter or leave the country.
Article 31: Gurkland recognize political asylum.
Article 32: The Monarchy guarantees that the work is a hobby for humans and is a perfectly voluntary agreement between two parties, the employer and the employee. For clones flexible working is a must.
Article 33: Every person has equal dignity and have equal right of access to natural resources.
Article 34: Every person has the full ownership of himself, of his body, and the fruits of his actions.
Article 35: Everyone has the right to freedom from fear.
Article 36: Every person has the right to undertake any activities he want to be peaceful and honest.
Article 37: The property owners haave the full right to control, use, and dispose in any way and enjoy their property without any interference of others, unless it violates their rights.
Article 38: Every person has the right to express themselves freely.
Article 39: Every person has the right to conduct any religious activity he desires that does not infringe the rights of others.
Article 40: Each adult is free to have any sentimental, relational and reproductive behavior with who wants and who will accept it, if doing so does not violate the rights of others.
Article 41: Each person can exercise control, management and ownership of a plot of land of any size paying a fee bargained with the local authority in terms and deadlines to be agreed.
Article 42: Public services are funded and managed at the local level.
Article 43: The age of majority is 12 years.
Article 44: The places of detention (prisons) are controlled by private companies exploiting criminals as cheap labor.
Article 45: Private companies that manage the prisons are obliged to respect the rights of prisoners who work, including protection against discrimination, abuse, bullying and give equal pay for equal work and the right to the hours of rest and recreation in prison.
Article 46: The Gurklandian government valorise the consolidating goal of both positive and negative liberties, has the responsibility of the collective welfare of its inhabitants and pursues the satisfaction of the rights and needs of individuals in freedom, with particular attention to the right to take energy (ie food and water for terrestrial), property rights, housing, economic progress and social and educational advancement to improve the happiness and prosperity of everyone.
