Constitution of Happy Utopia

Preamble

The Free Foundership of Happy Utopia intends to define this document as the common constitution of our union to preserve the identity of the region and guarantee its place in the multiverse.

POLITICAL ORGANIZATION

A1 It shall be established a Council of sovereign nations composed of the WA regional delegate and its executive members will be the officers of this region.

A2: The honorary, non-executive, members of the Council will be those who in the region and in the multiverse have showered our region with happiness and those who have distinguished themselves for their contributions, both at our region and elsewhere related.

A3: The nations of Happy Utopia have the right to form political parties and to run for the Council's executive positions, as well as to partecipate and vote for these positions.

A4: The honorary, non-executive members of the Council will be appointed at the discretion of the council's executive majority following a referendum.

A5 An executive member of the Council may not nominate itself or other executive members for the position of honorary member while in office, and have to wait a switch of political power from its political coalition to another coalition to be able to propose honorary members of the Council if the proponent is in power.

A6 Everyone in the region can propose the nomination of an honorary member of the Council, including proposing its title, as long as it doesn't violate grammar etiquette.

A7 The Council shall consist of a minimum of 1 representative for each 5 citizen nations existing in Happy Utopia.

A8 The Council shall represent the votes of the Happy Utopian nations, though political parties.

A9 Each party shall be given a percentage of seats that reflects the percentage of votes said party received.

A10 The Prime Minister of the Council shall be elected by the Council and appointed by the Sovereign Prince.

THE ROLE OF THE PRIME MINISTER

B1 The Prime Minister has veto power over any bills which the Council passes.

B2 The Prime Minister's veto may be vetoed by the Sovereign Prince

b3 The Prime Minister's role is intended to focus primarily on domestic policy.

THE ROLE OF THE SOVEREIGN PRINCE

C1 The Sovereign Prince may appoint the WA Delegate, with the approval of the Prime Minister.

C2 The Sovereign Prince may appoint judges, to determine if the Constitution is being followed.

THE ROLE OF JUDGES

D1 Judges may not be a member of a political party while they hold the office of judge.

D2 Judges may not have held any political position prior to being judges.

D3 These restrictions may not be held to judges after they have resigned.

D4 Judges are to interpret the Constitution, and may veto any action which they consider unconstitutional.

POLITICAL FREEDOMS

E1 Every nation can criticize the elected officials of Happy Utopia, as long as it is not in a manner intended to disrupt the peace of Happy Utopia (Such as spamming hate comments).

E2 Nations have the right to control the Council within their boarders as they see fit, and maintain any form of government they may choose.

E3 Any nation which desires to start a political party may do so, as long as they have a minimum of 2 other citizen nations which have agreed to join their party.

E4 No party may be dissolved by the Council of Happy Utopia for it's political leanings, unless the party is defying the rules of Nationstates.

E5 A nation shall not be required to join a political party in order to vote.

E6 These rules will apply when Happy Utopia has a citizenship number of 15, or greater.

E7 The Council shall represent the votes of the Happy Utopian nations, though political parties

E8 Each party shall be given a percentage of seats that reflects the percentage of votes said party received.

E9 Election shall be held each 4 months.

THE ROLE OF THE HIGH REPRESENTATIVE FOR FOREIGN AFFAIRS AND COMMON SECURITY POLICY

F1 The H.R. may be appointed by the Sovereign Prince, and the Prime Minister.

F2 If the Sovereign Prince, and the Prime Minister cannot come to an agreement, both the Sovereign Prince, and the Prime Minister may make one selection each, and these selections will be voted on by the Council.

F3 The H.R. may be a member of a political Party, but may not hold any other office, with the exception of leader of a political party, at the time of holding the office of High Representative for Foreign Affairs and Common Security Policy.

F4 If the H.R.'s party wins an election, the H.R. may either step down from the position of delegate, and serve in the Council or as Prime Minister, if requested by the party, and elected, or remain H.R.

F5 The H.R. will hold authority over Boarder Control, Embassies, and Represent Happy Utopia in the World Assembly, as Delegate.

F6 The H.R. Is to focus primarily on foreign affairs, such as alliances, the World Assembly, as well as the Ministry of Defense, as well as Boarder Control.

TITLES

G1 Changing the title of any elected officials, appointed officials, or of the Sovereign Prince, requires the approval of the individual holding the title at the time of the change, with the exception of a change in any gendered terms, in the event of a person of a different sex obtaining office. Such as Sovereign Prince, to Sovereign Princess.

G2 Changing a title involves the same process as an edit to the constitution, with the exception of a change in any gendered terms, in the event of a person of a different sex obtaining office. Such as Sovereign Prince, to Sovereign Princess.

EDITS TO THE CONSTITUTION

H1 member of Council may propose an edit to the constitution.

H2 edit must be approved of by a 2/3rd majority of Council and not be vetoed by the Prime Minister.

H3 The edit will then go to a popular vote, and all citizens of Happy Utopia may vote on it. If it receives a 3/4th majority approval, the edit will be enacted

H4 The edit may be vetoed by the Prime Minister, or Sovereign Prince at any time in this process.

H5 If the Democratic Process is not ongoing, due to a citizenship of less than 15, the Sovereign Prince may consult with any existing officials, and may edit the constitution.

Final note: All those rules above shall require the citizenship of Happy Utopia, which is granted by default unless the nation is violating any of the One Stop Rules Shop of the Nationstates Multiverse.

Raiders, grievers and political hackers may be shooted(ie:banned) on sight to provide for effective protection of Happy Utopia.
