Restrictions On Blood Sports

A resolution to restrict civil freedoms in the interest of moral decency.

The World Assembly,

ACKNOWLEDGING that sports such as bullfighting, cockfighting and dogfighting are popular amongst member nations;

HORRIFIED that in most of these cases at least one of the participants in such competitions is forced to participate, usually resulting in their death or serious injury;

BELIEVING that, for the safety and protection of all sentient beings, legislation in the form of a General Assembly resolution is needed to prevent such cruel and barbaric practices;

Hereby:

1. Defines a "blood sport" as a form of entertainment involving two or more living beings in which the aim is to injure or kill the opponent, not including hunting of non-sapient creatures;

2. Prohibits all forms of blood sports in which one or more of the participants did not provide consent;

3. Prohibits all forms of blood sports in which the aim is to kill the opponent, despite consent;

4. Requires member states to relocate all captive former sapient blood sport participants to a safe and healthy rehabilitative environment, such as their natural habitat, where they will not destroy the environment, be harmed or harm others;

5. Encourages member states to relocate all captive former non-sapient blood sport participants to a safe and healthy rehabilitative environment, such as their natural habitat, where they will not destroy the environment, be harmed or harm others;

6. Encourages members states to humanely put down non-sapient creatures groomed for blood sports if rehabilitation is not possible.

The Constitutional Court;

Article I: Applicable Law

1. Cites 25 a § of the Constitution of Latidonia, according to which: "Animals are sentient beings. Their inherent value, wellbeing and fundamental rights are to be fully respected by everyone. The interests and individual needs of animals must be taken into account in all private and public activities relevant to them."

2. Cites 25 b.1-2 § of the Constitution of Latidonia, according to which: "Animals dependent on humans have a right to life, security, integrity, natural behaviour and the right to have their basic needs adequately fulfilled. No one shall cause suffering or fear upon an animal."

3. Cites 25 d.1 § of the Constitution of Latidonia, according to which: "Public authorities and powers of the state shall guarantee the actualisation of animal fundamental rights and ensure the development of society as to realise these fundamental rights."

4. Notes that chapter 2 a of the Constitution of Latidonia establishes a guiding principle of absolute protection for animal rights.

Article II: Application of Law

5. Emphasises that the principle of animal rights cited in clause 4. is absolute and acts as an overarching interpretative tool for any decision concerning animals in any form.

6. Considers the intentions and potential consequences of the resolution to contribute to the principle of absolute animal rights in Latidonia.

7. Considers the intentions of the resolution at hand to be in accordance with the constitutional legislation cited in clause 1. and 2.

8. Furthermore considers the potential consequences of the resolution to altogether develop and otherwise contribute to the aforementioned.

9. Considers this contribution mentioned in parts 6 - 8 to be in accordance with the legislation cited in clause 3.

10. Considers the public authorities' obligation to ensure the actualisation of animal fundamental rights to be positive and imperative.

11. Therefore considers itself to be bound to support this resolution.
