Rights of the Employed Pros and Cons

Rights of the Employed
The Rejected Realms WA Information

Reasons to Vote For:
  • The proposal clarifies some protections from discrimination that people are granted by GA#35 explicitly on the basis of sexual and gender identity, such as freedom "from... pay discrimination and unfair dismissal".

  • Article E1 guarantees a minimum of eight weeks of fully-paid parental leave for all workers which individual members and employers can freely improve upon. This solves a major problem with Cosmosplosion's recently defeated proposal "on the Health and Financial Well-Being of Workers" wherein a rigid level of parental leave - itself combined with other forms of holiday and sick leave - was proposed.

  • Article D4 forbids employers from retaliating against their employees for participation in trials regarding discrimination in the workplace, which will empower workers to defend themselves against practices that are illegal both under this proposal and other prior international law.

Reasons to Vote Against:
  • This proposal is a very good example of what can be called a "one-size-fits-none" solution; small businesses will - for instance - find it much harder than larger companies to meet its requirement for a separate on-site breastfeeding room. It also does not allow for multi-purpose rooms to be used.

  • Various economic issues, detailed by Imperium Anglorum (who has expertise in this subject) here, including the incentive to gravitate towards freelance positions with this proposal, the lack of recognition of forced arbitration, and the problems with the usage of "under the age of majority", which includes 17 year olds, who likely do not need special care.

  • Article E3b requires that, if a worker sincerely requires breastfeeding, they are to be guaranteed one hour of breastfeeding time. It is unfortunate that this time cannot be more liberally allocated and must necessarily be guaranteed for a year even if the mother later finds formula milk to be sufficient. Additionally, employees are required to prove that they need to breastfeed, which may become problematic.

  • Although there is a requirement that workers not be subjected to sexual harassment in the workplace, it may be concerning that employers are only encouraged to create policies against such harassment (or, for instance, setting up relevant tribunals).
