Constitution of Lyrali

Mission

The mission of this Constitution is to create a safe and welcome environment for role-playing and all other activities in the region, Lyrali.


Preamble

In an effort to guarantee prosperity to the region, Lyrali, this Constitution shall be established as the Supreme document of the region.


Article I - Member States

Section I
Any nation that is present in the region shall be considered as a "Member State".

Section II
All member states shall be granted the following rights

  • Freedom of speech

  • Freedom of assembly

  • Freedom of the press

  • Freedom of religion and worship

  • Maintain a military without interference from the region or member states of the region

  • Maintain a government without interference from the region or member states of the region

  • Be guaranteed a fair and just trial, unless the region is in a state of war

  • Stay in or leave the region without interference, unless the founder or a majority of the member states of the region vote to eject a member state from this region

  • Campaign freely

  • Vote freely in both the region and the World Assembly

Section III
Member states have more rights than those acknowledged in Article I, Section II

Section IV
Nations not present in this region are considered "non-member states", and non-member states are not guaranteed the rights acknowledged in Article I, Section II.


Article II - Executive Power

Section I
The United Oceanian Isles shall be the sole legitimate founder of this region and shall hold executive power in perpetuity.

Section II
The World Assembly Delegate shall hold executive power. The Founder may remove powers from the Delegate, if necessary and proper. There shall be no elections for the World Assembly Delegate, rather, the nation with the most World Assembly endorsements shall become the World Assembly Delegate, giving member states the liberty to choose any nation they see fit for the Delegacy.

Section III
The Founder may not be removed from office. The World Assembly Delegate may be removed from office (see Article VI - Impeachment and Removal).


Article III - Legislative Power

Section I
There shall be elected officers in this region, which are the

  • First Minister, with authority over Appearance, Border Control, Communications, Embassies, and Polls

  • Minister of Foreign Affairs, with authority over Embassies, Communications, and Polls

  • Minister of Internal Affairs, with authority over Border Control, Communications, and Polls

  • Minister of Communications, with authority over Communications

  • Minister of Research, with authority over polls

  • Minister of the Homeland, with authority over appearance

Section II
The elected officers shall be listed in the region in the order in the above Article III, Section I.

Section III
The elected officers shall form the unicameral Parliament of Lyrali, the legislative branch of the Government of Lyrali. Each elected officer receives one vote in the Parliament.

Section IV
Any member state may propose legislation, and the Parliament of Lyrali has the power to approve legislations. All approved legislations shall be called "bills". For legislation to pass through Parliament, more than half of the members of Parliament must vote in favor of the legislation. If the Founder approves of a legislation, then that legislation shall become a law, even if the legislation was not approved by a majority of the Parliament. In the event of a tie in the Parliament, the World Assembly Delegate may cast one vote to settle the dispute.

Section V
Both the Founder and the World Assembly Delegate may veto bills passed by the Parliament. If the Founder vetoes a bill, then that bill shall not become a law. If the World Assembly Delegate vetoes a bill, then that bill shall be sent back to the Parliament. If a two-thirds majority of the Parliament votes to override the Delegate's veto, then the bill shall become a law. The Founder may at any time override the Delegate's veto (1).


Article IV - Judicial Power

Section I
Any member state breaking a law or found in violation of this Constitution shall be put on a public trial.

Section II
Public trials shall be conducted using a poll. Reasons for the member state being put on trial must be stated in the poll. There shall be two options in the poll, guilty and not guilty. All World Assembly members may vote in the poll (2). The accused member state and the victim, if there is a victim, may not vote in the poll. The accused member state shall be determined "guilty" if more than fifty percent of voters vote in favor of "guilty". Members that have provided evidence for the trial may not vote. If the result of the trial is a tie, where half of voters vote "guilty", and the other half of voters vote "not guilty", then the World Assembly Delegate shall make the decision. The Founder may, at any time, override the Delegate's decision (3), in which case the Founder makes the sole legitimate decision.

Section III
When a member state is determined to be "guilty", a second poll shall be published, in which voters eligible for the poll in the above Article IV, Section II may vote in. Voters may choose between "ejection" and "no ejection" in this poll. If more than fifty percent of voters vote in favor of "ejection", then the guilty member state shall be ejected from the region. If more than two-thirds of voters vote in favor of "ejection", then the guilty member state shall be ejected and banned from the region until either the Founder or the World Assembly Delegate unbans the guilty nation.

Section IV
The Founder may, at any time, eject or ban a nation from this region for whatever period of time the Founder determines is suitable.


Article V - Elections

Section I
Any member state of the World Assembly may have one vote in elections (4).

Section II
Any member state of the World Assembly may run for office (5).

Section III
Elections for officers shall be elected using a two-round runoff system, in which all the candidates for an office are listed in round one, and voters choose their favorite candidate. The two candidates with the most votes advance to round 2, and the remaining candidates are eliminated. The candidate with the most votes in round 2 wins the office.

Section IV
If more than two candidates get the top two most number of votes (for example: Candidate A - 3 votes, Candidate B - 3 votes, Candidate C - 3 votes, Candidate D - 2 votes), then all the candidates that received the top two most number of votes advance to round 2 (for example: Candidate A, Candidate B, and Candidate C advance to round 2), and round 2 will use a first-past-the-post system, in which the candidate with the most number of votes will win.


Article VI - Impeachment and Removal

Section I
Any elected officer, including the World Assembly Delegate, that fails to execute the duties of their office may be impeached.

Section II
An impeached member state shall be put on trial using a poll, in which the reasons for impeachment must be listed, and all World Assembly members (6) may vote "guilty" or "not guilty". If more than two-thirds of voters vote in favor of "guilty", then the impeached member state shall be removed from office, and a new election shall take place for that office.

Section III
If the World Assembly Delegate is impeached, and more than two-thirds of voters vote in favor of "guilty", then the Founder shall remove executive power from the Delegate until a new member state receives enough endorsements to become the new Delegate. The Founder should grant executive power to the Delegacy when a new member state becomes the World Assembly Delegate (7).


Article VII - Amendments

Section I
Any member state may propose to amend this Constitution.

Section II
More than two-thirds of Parliament must approve of the amendment for the amendment to be sent to the executive branch.

Section III
The World Assembly Delegate may veto an amendment, but the Founder may, at any time, override the Delegate's veto. The amendment shall come into effect when the Founder approves of the amendment.

Section IV
This article, Article VII, shall not be amended.


Article VIII - Emergencies

Section I
Both the Founder and the World Assembly Delegate may declare a State of Emergency, especially during and after an invasion.

Section II
The Founder may eject or ban any nation that took part in an invasion of this region.

Section III
Due to the likelihood that the World Assembly Delegate may lose executive power during an invasion, the Founder shall have sole executive power in the region.


Article IX - Interpretations

Section I
The World Assembly Delegate shall determine the meaning of any part of this Constitution that member states find unclear, obscure, or hard to understand by publishing their interpretation. The Founder may override the Delegate's interpretation, and the Founder's interpretation shall be the legitimate interpretation.

Section II
Any part of this Constitution could have a disputed meaning. The World Assembly Delegate may settle these disputed meanings by publishing their own interpretation, which shall be the legitimate interpretation unless the Founder published their own interpretation, in which the Founder's interpretation shall be the legitimate interpretation.


Article X - Enactment

Section I
This Constitution shall come into full effect with the approval of all the current members of the region, Lyrali.

Section II
Member states may have their own copy of this Constitution, but the Founder shall determine which copy shall be used for official purposes.
