Proposed FWO Constitution

Preamble
We the people, of The First World Order do hereby establish this constitution in order to form a more perfect union.

Article I

The Rights of the People
All nations, as long as they reside within the Republic, have their rights guaranteed and can make their own laws within their boundaries.

All nations are guaranteed the right to speak out against the government on the Discord, regional message board, or forum, provided that it confines to the rules of the platform. All nations have the right to free speech on the RMB (within confines of NS rules), on the Discord; however, excessively abusive or offensive comments are not allowed and may be punished by the President or Secretary of The Interior. Any objections to disciplinary action must be brought to the Judicial Branch, where it may be upheld or overturned.

No nation may be banned nor ejected from the region by a government official without reason stated on the RMB by said government official. No resident may be banned or kicked from the Discord server without reason stated on the RMB by the admin who performed the act.

All nations are encouraged to be active within the Republic, and participate in regional activities.

Any resident can bring an executive action before the court for a fair hearing if they define the executive action as violating the law.

Any Citizen, Resident, or Government Official cannot be convicted or tried twice for the same offense.

Article II

The Legislative
The Senate of The First World Order shall consist of all members that reside in The First World Order and are Citizens. It shall be recognized as the highest body representing the will of the Citizens of the Region, and by doing do, as the highest body representing the will of the Region.

Senators are responsible for creating the laws that govern the region, for making amendments to the constitution when needed, and for expressing the will of the Region by motions.

Senators shall vote aye, nay, or present on legislation, with those not voting or voting present not counted. Legislation must be seconded by at least one member of the Senate before being formally considered.

Legislation must be passed by a majority of those present, but no amendment to this document may be passed without two thirds of those present concurring.

The Senate may create and alter its own rules and procedures with the consent of two thirds of those present. Prior to passing any other act, the Senate must establish rules and procedure immediately upon its first deliberation.

The Senate may elect or provide for the appointment of officers to aid in the management and administration of the Senate, but all officers shall serve at the pleasure of the Senate.

Amendments to the constitution require a 2/3 majority. If one or more senators don’t vote, their vote is treated as “Present”.

All bills and amendments must be brought before the President to be approved or vetoed. Vetoes can be nullified by 2/3 of the senate.

Article III

The Executive
The Executive Power of The Republic of The First World Order shall be invested in the following officers for a term of 3 months;

The President shall be the Official head of the region, will Coordinates officers, Creates polls for proposals and other government reforms, will have the power to issue 3 executive orders per term, Can question lower officers suppressions, Can ban rule-breaking nations and will have the ingame power of Appearance, Border Control, Communications, Embassies and Polls.

The Vice-President shall be Second in command to the President and run in an election alongside the president. The Vice President will Fill in for the President if the President is not able to complete his/her duties, Break poll ties (Regardless of whether they voted in the poll already). The Vice President will be granted the ingame powers of Appearance, Border Control, Communications, Embassies and Polls.

The Secretary Of Defense shall Addresses regional security threats, Update regional alert system, Be In charge of operations with the armed forces, Can create defense pacts with other regions, will Create password protection when the situation requires it and will Notify the President of possible security threats.He shall be elected by the people, and shall be granted control over Appearance, Border Control, and Communications. He shall also be able to change the RAS level.

The Secretary Of The Interior shall be In charge of the citizen processing, and shall have the ingame power of communications and appearance.

The Interregional Diplomat Shall Handle interregional issues, will Conduct embassy closures and openers and Represents The First World Order to other regions, while holding the ingame position of WA delegate at the discretion of the interregional diplomat, with the WA, Border control, Appearance, embassy, and poll powers.

Article IV
Judicial
Up to three Justices can be appointed by the President based on their merit and will not hold mental reservations during a sentencing,

The Justices shall select one member from their body to serve as Chief Justice of the Supreme Court

Justices shall serve from their Senate approval until Senate approval of the succeeding Presidential nomination in the next term of office. There is no limit to how many terms a Justice can serve.

Justices nominated for office by the President must be approved by the Senate with a simple majority majority vote.

Justices shall exercise power within the confines of the Constitution and shall not seek to expand their influence beyond it’s limitation

Justices shall interpret the Common Law without having ideological or philosophical mental reservations (Judicial Activism)

If Justices are found engaging in one of the previous restricted behaviors, the Justice will be removed immediately from the bench with a two thirds vote of the senate.

The Justices can hear a case brought by any resident, decide on the legality of executive actions and order a reversal of the executive action.

Justices can not be voting Senators during a vote to remove a Justice.

Article V
Elections

Elections for President and cabinet shall be held every 3 months, on the 7th day of February, August, and November.

The new session of government shall begin 5 days following the election and certification of results.

A snap election for any office may be held if two thirds of the Assembly and the incumbent officer consent to such an election. This election must be held no more than ten days and no less than seven from the day of declaration.

An electoral committee shall be created 24 hours before any election to closely observe the results. The committee will be made up of one appointed member from each official political party, as well as any unaffiliated citizens necessary to bring the committee up to three members. The committee shall be able to challenge or report any suspicious or unlawful action made during elections to the Justices, who will decide whether the nation in question has done any wrong, and if so, their punishment.

Article VI
Ratification
This Constitution will be considered to come into effect once a majority of citizens have ratified it.
