Legislative Process Amendment (Act Overhaul)

Overview

Purpose

The amendment seeks to modify the Legislative Process Act to match current practices, consolidate the Legislature Conduct Act into it, and remove the region wide vote clauses.

Existing Law

  1. A law or amendment may be enacted through the following process:

    1. A dispatch shall be created according to the official guide dictating the structure of laws and amendments

    2. One member of the General Assembly that chooses to support its introduction shall become its signatory and submit it for General Assembly discussion

    3. It shall be published on the Regional Message Board for public feedback for a minimum of one day

    4. Unless otherwise indicated, it may be enacted with a majority of non-abstaining members of the General Assembly in favour over a voting period of two days

    5. After the voting period ends, those members of the General Assembly who have not voted shall be recorded as such

  2. A minor, inconsequential amendment shall be exempt from Section 1 and instead may be enacted through the following process:

    1. A motion shall be presented to the General Assembly and its status as such may be confirmed with a majority of non-abstaining members of the General Assembly in favour over a voting period of one day

    2. Unless otherwise indicated, the motion may then be enacted with a majority of non-abstaining members of the General Assembly in favour over a voting period of two days

    3. The Supreme Court may repeal any such motion deemed to not satisfy the definition of a minor, inconsequential amendment

  3. Any legislation requires a majority of Members of the General Assembly to cast a vote for it to pass

  4. Any legislation may be put to a region wide vote if:

    1. A motion shall be endorsed by five percent of electoral citizens and then the petition shall then be sent to the Speaker to review that it has met the requirements

  5. The Speaker shall announce if the petition has been successful on the Regional Messaging Board

  6. World Assembly citizens shall be permitted to vote in a two-day poll

  7. Military Voting and Dual citizens shall be permitted to vote on the Regional Message Board in the same period

Proposed Law

  1. A proposal for a new law or an amendment to an existing law shall be proposed via the following process:

    1. A citizen nation shall author a dispatch detailing the piece of legislation in accordance to an official guide curated by the Speaker or a designee of the Speaker

    2. The author nation shall, with the permission of any nations included in the signatory section of the proposal, include the name of at least one member of the General Assembly or five percent of electoral citizens as signatories

    3. The author nation shall deliver the proposal to the Speaker, who shall add it to Legislative Queue if it is in accordance with all other clauses of this law

      1. The Speaker shall, at their discretion, mark the proposal as "High Priority", "Normal Priority", "Low Priority", or "Minor"

      2. A proposal may only be marked as "Minor" if it has no consequence on the execution or interpretation of the law

  2. A proposal at the top of the legislative queue shall be announced on the Regional Message Board for public feedback for a minimum of one day

    1. The public feedback period may be extended at the discretion of the Speaker, or if there is ongoing and substantial discussion regarding the proposal

    2. Once the proposal has been announced on the Regional Message Board, any modification made to it shall cause the public feedback period to reset to one day from the most recent edit and the author must announce and detail any modifications made

    3. The Speaker may, at any time during the public feedback period, withdraw a proposal from public feedback and introduce a new proposal

  3. Following the public feedback period, the proposal shall be voted on by Members of the General Assembly over a period of two days, or until all Members of the General Assembly have cast a vote or confirmed that they are abstaining from voting

    1. During the voting period a member of the General Assembly may vote for or against the proposal or may abstain from voting

    2. Every member of the General Assembly who casts a vote for or against the proposal shall express a reason for their vote

    3. If the two day voting period has expired, and any member of the General Assembly who failed to cast a vote or confirm that they are abstaining, such members shall be recorded to have abstained in absentia, and their stance tallied as abstain

    4. Once the proposal has been presented to the General Assembly for voting, the author may not make any modification to the proposal or withdraw the proposal from consideration, nor may the Speaker withdraw the proposal from voting unless otherwise required by regional law

    5. Voting shall take place in a channel freely accessible to the citizenry of The Leftist Assembly

    6. Vote tallies and expressed reasons for votes shall be reported to the citizenry of The Leftist Assembly via the Regional Message Board before the next piece of legislation is introduced for public feedback

  4. A motion shall pass if all of the following conditions are true:

    1. All parts of the Code of Laws and Constitution were followed in the passage of the motion

    2. A majority of members of the General Assembly submitted a non-abstaining vote

    3. A majority of members of the General Assembly who submitted a non-abstaining vote submitted a vote for the motion

  5. A motion shall fail if any of the aforementioned conditions are false

  6. A proposal marked as "Minor" may, at the discretion of the Speaker, go through the following process in lieu of the aforementioned process:

    1. A motion shall be presented to the General Assembly confirming its status as minor with a voting period of one day, and may be passed as a regular motion

    2. If this motion fails, the proposal shall continue as a normal proposal

    3. If this motion passes, the proposal may then be enacted by the following process:

      1. During the voting period a member of the General Assembly may vote for or against the proposal or may abstain from voting

      2. If the one day voting period has expired, and any member of the General Assembly who failed to cast a vote or confirm that they are abstaining, such members shall be recorded to have abstained in absentia, and their stance tallied as abstain

      3. Voting shall take place in a channel freely accessible to the citizenry of The Leftist Assembly

      4. Vote tallies shall be reported to the citizenry of The Leftist Assembly via the Regional Message Board before the next piece of legislation is introduced for public feedback

    4. The Supreme Court may immediately repeal any motion that is deemed to have a consequence on the execution or interpretation of the law

  7. Any motion passed by the General Assembly may not be challenged on grounds of failure to follow due process or not being legally a minor motion after the election of a Speaker for the subsequent General Assembly

  8. Any violation of these provisions, with intent, shall be regarded as a moderate criminal offence
