AI Copyright Leniency Act

Article 1: Definitions
1.1 "AI" refers to artificial intelligence systems, algorithms, or any other software-based technology capable of generating text and replicating human cognitive abilities.
1.2 "AI-Generated Text" denotes any textual work or content produced, in whole or in part, by an AI system without direct human intervention.
1.3 "Human Origin" refers to an AI-Generated Text that was initially conceptualized and outlined by a human, outlining the general idea or concept, which the AI system expanded upon and generated autonomously.

Article 2: Legalization of Copyright for AI-Generated Text with Human Origin
2.1 AI-Generated Text that originates from a human-conceptualized general idea shall be eligible for copyright protection under the following conditions.
2.2 Copyright protection shall apply to the human-originated general idea and the unique elements added by the AI system during the text generation process.
2.3 The copyright holder shall have the exclusive rights to reproduce, distribute, display, and publicly perform the copyrighted AI-Generated Text.
2.4 The copyright duration for the AI-Generated Text shall be subject to applicable intellectual property laws and regulations.

Article 3: Criteria for Copyright Eligibility
3.1 The human-conceptualized general idea must possess a sufficient level of originality and creativity, demonstrating a notable contribution or unique expression beyond common or generic concepts.
3.2 The AI-Generated Text must exhibit substantial transformation and sufficiently distinguishable features from pre-existing works or commonly employed language patterns.
3.3 The AI system generating the text must be sufficiently autonomous in its decision-making process without direct human involvement beyond the initial conceptualization.

Article 4: Copyright Ownership and Transfer
4.1 The initial copyright ownership of AI-Generated Text with Human Origin shall vest with the human who conceptualized the general idea, fulfilling the criteria set forth in Article 3.
4.2 Copyright ownership rights can be transferred, assigned, or licensed to another individual or entity through voluntary agreements or contractual arrangements.

Article 5: Limitations and Fair Use
5.1 Fair use provisions shall apply to AI-Generated Text with Human Origin, allowing for certain limited uses without infringing the copyright holder's rights.
5.2 Fair use factors, such as purpose, nature, amount, and effect on the market, shall be considered in determining permissible usage.
5.3 Non-commercial educational or research purposes, transformative works, criticism, commentary, parody, or news reporting may be considered fair use, subject to relevant legal standards.

Article 6: Dispute Resolution and Enforcement
6.1 Disputes arising from copyright ownership, infringement, or related matters concerning AI-Generated Text with Human Origin shall be adjudicated through existing intellectual property laws and dispute resolution mechanisms.
6.2 Enforcement agencies shall be empowered to investigate, penalize, and deter copyright infringement of AI-Generated Text with Human Origin in accordance with applicable laws, regulations, and judicial procedures.

Article 7: Compatibility with International Copyright Standards
7.1 This law shall be interpreted and applied in a manner consistent with international copyright treaties, agreements, and conventions deemed ratified by the relevant jurisdiction.
7.2 If any provision of this law conflicts with international obligations, the international obligations shall prevail to the extent necessary to resolve the conflict.

Article 8: Effective Date
8.1 This law shall come into effect on the date of its publication.
8.2 Previously existing AI-generated text works shall not be retroactively subjected to this law.
