Constitution of The Hive
Preamble
We the residents of the region named Hive, in order to establish law and order, equality, liberty, justice and fraternity among us, Hereby establish the Constitution of Hive. We declare our region as a "Parliamentary Democracy" and a "Crowned Republic".
The term "region" shall henceforth refer to the region of Hive and The term "resident(s)" refer to any nation currently residing in the region.
Article 1: Fundamental Rights
1. This Article contains rights of a resident of the Hive.
1.1. Hive is open to everyone, whatever their political beliefs or opinion, as long as they are respectful and behave with dignity.
1.2. Every Resident has the right to express their opinion and ideas through any frontiers of media.
1.3. Every Resident has the right to seek, receive and
give information about the government.
1.4. No discrimination is allowed, including but not limited to discrimination based on age, sex, gender, sexual orientation, ethnicity, belief, background, status, race and caste
1.5. A resident’s rights is only limited to protect the rights of others, and to allow for a functioning and just system where they are able to live and thrive in.
1.6. All Residents are free and equal in dignity and rights.
1.7. Every Resident is free to stay in the region, as well as to move to or from it.
1.8. Every Resident has the right to free choice, autonomy, security and the freedom to choose to associate.
1.9. Residents are able to express their will through genuine elections held by free voting procedures.
1.10. Every Resident has the right to take part in the Government, directly or through freely chosen individuals or groups.
1.11. Residents have the right to government transparency at all times. They have the right to request the government to make their internal conversation public. They also have the right to participate in government debates.
1.12. No resident can be punished without good reason.
A. Ever resident accused of crossing our laws is presumed innocent until proven otherwise in a public trial according to our law.
B. In a trial, every resident has the right be heard by impartial and independent judges.
C. Suppressing, ejecting, banning, banjecting or being reported to NS moderators are punishments, but not the only ones.
D. No resident can be treated poorly or without respect.
E. Laws can’t be used retroactively.
Article 2: The Government
2. This Article Defines how the Government of Hive Works and what are the responsibilities of each positions.
2.1. Government of The Hive is headed by the Prime Minister. It is an elected position.
2.2. The Prime Minister is granted all the authorities over the region except Border Control.
2.3. The Prime Minister may veto a law passed by the Legislature. The veto may be turned over by the Legislature following a 2/3 vote.
2.4. The Prime Minister shall appoint a Cabinet to assist in the execution of laws and the advisement of the government. This Cabinet shall execute the will of the Prime Minister. All decisions related to the positions, power, number, and function of the Cabinet members are up to the discretion of the Prime Minister, subject to the approval of the Legislature. However, no Cabinet member may have all Regional Officer powers. The Prime Minister may relieve Cabinet members of their duties without the approval of the Legislature.
2.5. The Government may negotiate foreign treaties and alliances, subject to the vote of the Legislature.
2.6. The Prime Minister has the power to issue Executive Orders. Executive Orders can be repealed through judicial review by the Judiciary or if the Legislature passes legislation against them with ⅔ majority vote.
2.7. The Prime Minister and any of the Cabinet members may be impeached by the Legislature.
2.8. If a Cabinet member or the Prime Minister is unable to perform their duties, by reason of inactivity, ceasing to exist, or any other cause, they will be replaced immediately by the President if a Cabinet member or by a special election if they are the President.
Article 3: The Legislative Branch
3. This article defines the legislative body of Hive, their function, authorities and uses
3.1. The Legislature shall be the sole legislative authority of the Region. It is a unicarmal house made up of the residents of the region. Any Resident can vote in the election as long as they are in the region and have no criminal records within the region.
3.2. The Legislature may enact, amend, or repeal most laws and treaties for the Free Nations Region by a simple majority vote.
3.3. The Legislature may impeach any official of the government of the Region by a two-thirds majority vote, the process for which consists of passing a bill of impeachment which describes the reasoning behind.
3.4. The Legislature may override a Presidential Veto by a two-thirds majority vote.
3.5. The Legislature may declare a state of crisis by a two-thirds majority vote.
3.6. The Legislature may amend this Constitution by a two-thirds majority vote.
3.7. The Legislature shall elect a Speaker who may introduce legislation and shall put legislation up to vote. The Speaker is the head of the Legislature, and is elected by the members of the Legislature every 3 months.
3.8. All votes of the Legislature shall be open for three (3) days unless otherwise determined by the Speaker.
Article 4: The Founder
4. This Article defines the role of the founder in our region.
4.1. The Founder is anyone who controls the account Hive Founder.
4.2. The Founder shall henceforth be named as the "Hive King/Queen".
4.3. Hive King/Queen is a ceremonial position which functions as Head of State. The Hive King derives its authority from being the original and first nation in the Region and holds office until death.
4.4. The Hive King/Queen has the sole authority to eject or ban nations (border control authority) except during a time of crisis.
4.5. The position of the Hive King/Queen does not have any direct influence on the running of the government, and may not appoint, remove, or change any part of the government unless acting upon the behest of the legal act of Prime Minister, Legislature, or Judiciary; however, the Founder may hold additional positions in the government of the Region or States. While holding the office of any additional positions, the Founder is still subject to any laws or boundaries defined for that position.
4.6. Hive King/Queen shall carry out all actions of the President, Legislature, and Judiciary at their behest in accordance with the law. The Founder maintains supreme authority but must adhere to the will of the Citizens.
4.7. During a time of Crisis, the Hive King/Queen may be granted additional permissions and executive authority.
4.8. Hive King/Queen is the owner, and main administrative officer of the forum.
4.9. Hive King/Queen shall ensure that the region is running smoothly and that the Regional Government is active.
Article 5: The Judiciary
5. This Article Defines the Judicial Body of the Hive. It explains their functions, duties and responsibilities.
5.1. The Judiciary shall decide all cases and disputes between Residents or between Residents and the Region It shall also determine the constitutionality of laws and government actions.
5.2. The Judiciary shall be composed of 2 (two) Judges who shall be appointed by the Legislature for an indefinite term, unless they resign, are impeached, leave the Region, or are removed for any other reason.
5.3. No Judge may hold any other office within the government of the Region while holding the position of Judge.
5.4 No Judge may be a member of a regional political party while serving as a Judge.
Article 6: Elections
6. This Article defines how and when elections for each positions are held.
6.1. Elections of Hive are free, open, and direct.
6.2. The Prime Minister is an elected office and shall serve a term lasting ninety (90) days.
6.3. The Speaker is an elected office and shall serve a term lasting ninety (90) days.
6.4. The WA Delegate is an elected office and shall serve a term lasting one eighty three (183) days.
6.5. An Election Season shall start of the first day of the month, in the months of January, April, July, and October.
6.6. In order to run for an elected office a person should be a resident of the region and have resided here for at least 14 (Fourteen) Days.
6.7. Elections shall be won by a majority vote (50% +1 or higher). If no candidate receives a majority, there shall be a runoff election between the two candidates with the most votes which will end in 24 hours. If the election is tied, then there will be a Coalition Government.
6.8. In case of an impeachment or otherwise a vacancy in an elected position, a Special Election shall immediately begin for that office. Special Elections shall function in the same method as a normal Election Season. However, if the Special Election would begin less than a month before or after a normal Election Season, the normal Election Season for that position shall be called off.
Article 7: Offsite Communication
7. This Article defines the modes of Communication of our region apart from Nationstates.
